agreement between the BYTES Genesis Products/Services user ("User" or
"you") and the Applicable BYTES Genesis Company ("BYTES Genesis,"
"BYTES Genesis," "we" or "us") as defined in this document.
Please
ensure that you completely comprehend this Agreement's content. If you
have any doubts about any of your rights and responsibilities arising
from accepting this Agreement, kindly consult us or get legal
assistance.
This Agreement involves and hereby incorporates the Terms
of Use of our Products or Services, as this Agreement may be effective
from moment to moment by BYTES Genesis, available at
https://www.bytesgenesis.com/
IF YOU DO NOT AGREE WITH THIS AGREEMENT,
MAY NEITHER CONTINUE WITH THE PROCESS OF REGISTRATION NOR FURTHER USE
THE SERVICES.
REGISTRATION AND ACCOUNT
Products/Services utilization
You can either use the Services as a registered user or as an
unregistered user. However, if you are not of legal age to enter into
agreement in your jurisdiction or if you do not have the power to
accept this Agreement, you may not use the Products/Services as a
licensed or unregistered user. Please do not try to register for the
Services or send us any information about you, including your name,
address, telephone number, or email address, if you are under 18. If
we discover that we have gathered private data from anyone under the
age of 18 without parental consent verification, we will remove this
data as soon as possible. Registering as a user can provide you with
the following extra advantages over using the visitor (non-registered)
capabilities of the Services: monitoring marketing campaigns and
viewing the history of demands, maintaining your preferences and other
environments, etc.
Acceptance
You agree to the terms of this Agreement
by using the Products/Services and you completely authorize us to
acquire, process, store, use and communicate your private information
in accordance with our Privacy Policy, which is an essential component
of this Agreement.
Representations of users
By using the
Products/Services, you represent and warrant that (a) all registration
data you submit is truthful and precise; (b) you retain the precision
of such data; (c) you are at least 18 years of age and have the
ability and power to enter into this Agreement; and (d) your use of
the Products/Services does not violate any applicable law or
regulation.
Registration
You must establish a user account on the
website to register as a user by following the registration processes
and guidelines set out in it. There are no costs to generate an
account for BYTES Genesis User. However, you will be needed to provide
billing information in order to access certain paid characteristics of
the Products/Services. As a registered user, you agree to quickly
notify us of any modifications to the information of your billing.
User account, unless otherwise indicated in your BYTES Genesis
subscription plan, is intended and intended for use by an individual
user. In addition to the number of users specified in your BYTES
Genesis subscription plan, you may not give additional users access to
your User account. If BYTES Genesis detects multiple users who
commonly access the same user account from different places, devices
and IP addresses, BYTES Genesis may, at its sole discretion, instantly
suspend or terminate this user account.
Login, password for
Products/Services and Tokens for Chatbots
You are exclusively liable for maintaining
all your BYTES Genesis user accounts, including, but not restricted
to, your user login, password and BOT Token. BOT Token is Link
generated during BOT creation and can only be accessed by your
website. You agree that you will not share your BOT Token with any
third party Websites.
Responsibilities for the user
You are
responsible for all of the following in connection with your use of
the Products/Services: maintaining the security of your User Account
and all the activities that take place on your User Account;
maintaining accurate account information at all times, including a
valid email address and accounting information, and updating such
information as necessary; gaining access to the Products/Services,
which may invalidate access.
De-Registration
You can always delete
your user account. Please note that all your data and information
stored on BYTES Genesis servers will be deleted and BYTES Genesis will
not bear any liability for such data or information loss.
Notwithstanding all product/service fees incurred prior to
de-registration, such de-registration will be due and owing until
payment in full.
Conclusion by BYTES Genesis
BYTES Genesis reserves
the right to terminate any User account in its sole discretion for
abusive or fraudulent behavior, non-compliance with this Agreement or
for any other reason.
Termination
Right to terminate. Each party may
terminate this Agreement at any moment at their sole discretion with
written notice to the other party if terminated by BYTES Genesis,
which notice is to be given to a user of paid product/services at
least 10 days before the date of termination.
Termination effect
Upon
termination of this Agreement, all rights of the user concerned in
connection with the use of the Website or Services shall be terminated
instantly.
Survival
Once this Agreement has been terminated for any
reason, all regulations relating to compensation, warranty, liability
and limitations thereon, and the confidentiality and protection of
proprietary freedoms and trade secrets, and any provisions expressly
or by their nature needed to endure such termination in order to
attain their objective, shall survive until such time as this is no
longer essential.
Price & Package
Price & Package are depending upon
the chatbot categories,nature of services and type of products. Some
of the Chatbot/Product/Service categories are given to Customers as
Free Packs, while some are charged and their price & package details
are mentioned on our website with respect to specific
chatbot/product/service. These price & package plans may subject to
change anytime due to certain market evaluation and costing criteria
and when ever this price and package variates it will be informed in
prior to our valued customers.
Refund policy
Customer are given either
with free trail for limited time before subscribing the paid plan or
we provide complete written details of our chatbots/products/services
with full screen records which shows complete functional details.
Since once our chatbots/products/services are deliverd to our customer
with full functional authority and the inside substance(like content,
programming codes, A.I. based functions, users interfaces, technology
working mannuals, I.O.T blue prints, etc. etc.) of
chatbot/product/service is fully exposed to our customer then it is
considerd as a business suicide for accepting any claims of
refunds/returns. Therefore we are not responsible for any kind of
refund or returns and we don’t offer any refunds due to any reason,
once we deliverd the committed chatbot/product/service. We work on the
principle that if the things won't work then our team make it to work
as per our commitment (after sales policy) but we won't accept any
kind of refund/returns.
Payment Policy
For any Billing issues, you
must notify us within 5 working days after your Billing statement from
Invoice date or Transactional statement for your Bank Account or
Credit Card Company or international merchat exchange gateway, after
that time limit it will be consider as your acceptance of our charges,
failure of payment of your subscription charges result in deactivation
of your account and your account will be activated only when the
Payment is successfully acknowledged.
After Sales Policy
We at BYTES
Genesis provides complete after sales support to our valued customers.
It includes, a) pre installation services, which guides our customer
how to make things functional at your end. This includes screen
records, video tutorials, email correspondence, skype session etc.
etc. b) in operation services, which is actually a customer support by
using online links while things are in function. It includes updates,
features and functional enhancements, tips and tricks, bugs fixing
etc. etc. We believe in full customer satisfaction with a motive of,
"once being our client then always being our client".
